Section 1 – Introduction and Acceptance
Welcome to Shawir.
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Smart Soft Solutions Commercial Brokerage ("Shawir," "we," "us," or "our"), a company registered in Abu Dhabi, United Arab Emirates.
These Terms govern your access to and use of the Shawir Platform, including the Shawir website (shawir.com and affiliated websites), mobile applications (iOS and Android), and any related products, services, features, tools, interfaces, or digital experiences operated under the Shawir brand (collectively, the "Platform").
By accessing, browsing, registering for, downloading, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any policies referenced herein.
If you do not agree with these Terms, you must immediately discontinue using the Platform.
Shawir reserves the right to modify, amend, replace, supplement, or update these Terms at any time, at its sole discretion, without prior notice.
Any modifications become effective immediately upon publication on the Platform or through any other communication method determined by Shawir.
Your continued access to or use of the Platform after any modification constitutes your full acceptance of the revised Terms.
If you do not agree with any updated Terms, you must immediately discontinue using the Platform and, where applicable, delete your account.
Users are responsible for reviewing the latest version of these Terms periodically.
These Terms should be read together with Shawir's Privacy Policy and any other policies referenced herein, each of which forms an integral part of this Agreement where applicable.
Section 2 – Definitions and Interpretation
For the purposes of these Terms, the following definitions apply unless the context requires otherwise.
Platform
The Shawir website, mobile application, affiliated websites, products, services, tools, interfaces, technologies, APIs, features, and all digital experiences operated under the Shawir brand by Smart Soft Solutions Commercial Brokerage.
User
Any individual who accesses, browses, registers for, or uses the Platform, whether as a guest or a registered account holder, including followers, fans, customers, or any other person interacting with Creators through the Platform.
Guest
Any individual who accesses or browses the Platform without creating or signing into an account.
Creator
An independent individual or legal entity approved by Shawir to publish Content, interact with Users, and offer services, experiences, digital products, or other offerings through the Platform.
Session
Any interaction between a User and a Creator, including but not limited to private chat, voice calls, video calls, scheduled sessions, live interactions, or any future communication format introduced by Shawir.
Services
Any content, interaction, consultation, experience, digital product, event, subscription, community feature, or other offering made available by a Creator through the Platform, including future services introduced by Shawir.
Content
Any text, image, photograph, illustration, graphic, logo, audio, video, livestream, message, profile information, review, rating, comment, file, document, AI-generated material, or any other digital material published, uploaded, transmitted, received, or shared through the Platform.
Points
The virtual currency issued by Shawir for purchasing Services and other eligible transactions within the Platform.
Points have no monetary value outside the Platform unless expressly required by applicable law.
Wallet
The User's or Creator's in-app balance used to hold, spend, receive, or manage Points and other Platform credits.
KYC
Know Your Customer procedures conducted by Shawir for identity verification and compliance purposes.
Company
Smart Soft Solutions Commercial Brokerage, the legal owner and operator of the Shawir Platform.
Interpretation
Unless the context requires otherwise:
Words importing the singular include the plural, and vice versa.
References to any gender include all genders.
References to "including" mean "including without limitation."
Section headings are for convenience only and do not affect interpretation.
References to the Platform include future versions, updates, technologies, features, services, products, and functionality introduced by Shawir.
Any reference to applicable law includes future amendments, replacements, or successor legislation.
Section 3 – Nature of the Platform
Shawir is a technology platform that enables communication, engagement, and commercial interactions between Users and independent Creators.
The Platform provides the technical infrastructure, communication tools, payment systems, discovery features, booking functionality, and related technologies that enable these interactions.
Shawir does not create, commission, employ, supervise, manage, control, or direct Creators or the Content and Services they provide.
Creators operate independently and remain solely responsible for their profiles, Content, Services, pricing, availability, communications, opinions, recommendations, qualifications, representations, and interactions with Users.
Shawir does not verify or guarantee the accuracy, completeness, legality, reliability, qualifications, credentials, licensing, experience, opinions, advice, recommendations, or outcomes associated with any Creator or any Service made available through the Platform.
The presence of any Creator on the Platform shall not constitute an endorsement, recommendation, certification, guarantee, employment relationship, partnership, agency, or approval by Shawir.
Unless expressly stated otherwise, all communications, Sessions, purchases, bookings, transactions, Services, and interactions available through the Platform are conducted solely between the User and the Creator.
Shawir's responsibility is strictly limited to providing, maintaining, securing, improving, and operating the Platform.
Nothing contained within the Platform or these Terms shall be interpreted as creating an employment relationship, partnership, agency, franchise, fiduciary relationship, joint venture, or any similar legal relationship between Shawir and any Creator.
Section 4 – Eligibility and Registration
4.1 Eligibility
To access or use the Platform, you must:
Be at least 15 years of age, or the minimum legal age required in your country of residence, whichever is higher.
Have the legal capacity to enter into a legally binding agreement.
Comply with all applicable laws, regulations, sanctions, licensing requirements, and governmental obligations in your jurisdiction.
Use the Platform only for lawful purposes and in accordance with these Terms.
If Shawir determines that an account has been created or used in violation of these requirements, Shawir reserves the right to suspend, restrict, or permanently terminate the account without prior notice.
4.2 User Registration
Certain features of the Platform require registration.
By creating an account, you agree to:
Provide accurate, complete, and current information.
Keep your account information updated.
Maintain the confidentiality of your login credentials.
Accept full responsibility for all activities conducted through your account.
Notify Shawir immediately of any unauthorized access, suspected security breach, or misuse of your account.
You are solely responsible for maintaining the accuracy of the information associated with your account throughout your use of the Platform.
Shawir reserves the right to request additional information or verification at any time where reasonably necessary to comply with applicable laws, protect the Platform, or prevent fraud.
4.3 Creator Registration
To become a Creator, applicants must successfully complete Shawir's registration, verification, and approval process.
The approval process may include, without limitation:
Identity verification (KYC).
Verification of social media accounts or other online presence.
Review of publicly available content.
Verification of qualifications, licenses, certifications, or professional experience where applicable.
Submission of supporting documentation requested by Shawir.
Manual review by Shawir.
Submission of an application does not guarantee approval.
Shawir reserves the absolute and sole discretion to approve, reject, suspend, revoke, re-evaluate, or request additional information for any Creator application or account at any time, with or without providing a reason.
Approval as a Creator does not constitute certification, accreditation, endorsement, recommendation, or verification of any qualifications, licenses, professional status, expertise, or experience.
Creators remain solely responsible for the accuracy and legality of all information, qualifications, credentials, claims, Services, and Content published through the Platform.
4.4 Account Security
Users and Creators are responsible for maintaining the confidentiality and security of their accounts and login credentials.
You agree not to:
Share your account with another person.
Allow another person to use your account.
Sell, transfer, lease, or assign your account without Shawir's prior written approval.
Create multiple accounts for fraudulent, deceptive, or abusive purposes.
Shawir shall not be liable for any loss arising from unauthorized use of your account resulting from your failure to protect your login credentials.
4.5 Account Verification
Shawir may verify the identity of any User or Creator at any time.
Failure to complete requested verification procedures within the specified timeframe may result in:
Temporary account restrictions.
Suspension of Platform features.
Delayed payments or withdrawals.
Permanent account termination.
Verification requirements may change from time to time in response to legal, regulatory, security, fraud prevention, or operational requirements.
Section 5 – Platform Protection and Limitation of Liability
5.1 Technology Platform
Shawir is solely a technology platform that facilitates communication and transactions between Users and independent Creators.
Shawir does not provide, supervise, manage, guarantee, recommend, endorse, or assume responsibility for any Creator, Content, Service, Session, opinion, recommendation, representation, or information made available through the Platform.
5.2 No Endorsement
The presence of any Creator, profile, verification badge, recommendation, rating, review, featured placement, search result, advertisement, or promotional material on the Platform shall not constitute an endorsement, recommendation, certification, guarantee, partnership, or approval by Shawir.
Users remain solely responsible for evaluating the suitability of any Creator before engaging with any Service.
5.3 No Responsibility for Content
All Content available through the Platform is created, published, and controlled solely by its respective User or Creator.
Shawir does not routinely monitor, edit, pre-screen, approve, verify, or guarantee the legality, accuracy, completeness, quality, reliability, suitability, or availability of any Content or Service.
Any opinions, recommendations, advice, statements, or information expressed through the Platform belong solely to the respective Creator or User.
5.4 Independent Decisions
Users acknowledge that all decisions made based on information obtained through the Platform are made voluntarily and entirely at their own risk.
Shawir shall not be liable for any direct or indirect consequences arising from reliance upon any Content, recommendation, communication, opinion, Session, or Service provided through the Platform.
5.5 No Professional Relationship
Unless expressly stated otherwise, nothing available through the Platform shall be interpreted as constituting medical, legal, financial, accounting, investment, psychological, therapeutic, educational, governmental, religious, or any other regulated professional service.
Where a Creator claims to possess professional qualifications, licenses, certifications, or experience, such claims remain solely the responsibility of that Creator.
Users are responsible for conducting their own evaluation before relying upon any Creator or Service.
5.6 Limitation of Liability
To the maximum extent permitted by applicable law, Shawir's total aggregate liability arising out of or relating to the Platform or these Terms shall not exceed the total amount paid by the User to Shawir for the specific transaction giving rise to the claim.
Under no circumstances shall Shawir be liable for any indirect, incidental, consequential, punitive, exemplary, special, or similar damages, including but not limited to:
Loss of profits.
Loss of revenue.
Loss of business opportunities.
Loss of anticipated savings.
Loss of goodwill.
Loss of reputation.
Loss of data.
Business interruption.
Emotional distress.
Any other indirect or consequential damages.
This limitation applies regardless of the legal theory upon which the claim is based and even if Shawir has been advised of the possibility of such damages.
5.7 User Responsibility
Users and Creators are solely responsible for:
Their decisions.
Their communications.
Their conduct.
Their Content.
Their Services.
Compliance with applicable laws.
Their relationships and agreements with other Users or Creators.
Any taxes, licenses, permits, or reporting obligations applicable to their activities.
5.8 Indemnification
You agree to indemnify, defend, and hold harmless Shawir, Smart Soft Solutions Commercial Brokerage, its affiliates, shareholders, directors, officers, employees, contractors, representatives, partners, licensors, successors, and assigns from and against any claims, liabilities, damages, judgments, losses, penalties, fines, costs, expenses, and reasonable legal fees arising from or relating to:
Your use of the Platform.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your Content or Services.
Any dispute between you and another User or Creator.
Any negligent, fraudulent, unlawful, misleading, or intentional act committed by you.
Any infringement of intellectual property, privacy, publicity, or other legal rights.
This indemnification obligation shall survive the suspension, termination, or closure of your account.
Section 6 – User Obligations and Acceptable Use
6.1 User Responsibilities
By accessing or using the Platform, you agree to use it responsibly, lawfully, and in accordance with these Terms.
You agree that you will:
Provide accurate, complete, and truthful information.
Respect the rights, privacy, dignity, and intellectual property of others.
Communicate respectfully with other Users and Creators.
Use the Platform only for its intended and lawful purposes.
Comply with all applicable laws, regulations, and governmental requirements.
Maintain the security of your account and devices.
Cooperate with Shawir where reasonably required for security, compliance, fraud prevention, or dispute resolution.
6.2 Prohibited Activities
You agree that you will not:
Violate any applicable law or regulation.
Circumvent or attempt to bypass the Platform's payment system.
Request, offer, or accept payment outside the Platform for Services initiated through Shawir.
Share personal contact information with the intention of completing transactions outside the Platform.
Encourage another User or Creator to avoid using the Platform for future transactions.
Use automated software, bots, crawlers, scrapers, scripts, AI agents, or similar technologies to access or interact with the Platform without Shawir's prior written authorization.
Attempt to gain unauthorized access to any account, system, database, server, API, or network.
Upload or distribute viruses, malware, ransomware, spyware, or any harmful code.
Interfere with the operation, availability, integrity, or security of the Platform.
Reverse engineer, decompile, exploit, or probe the Platform for vulnerabilities.
Impersonate another person or entity.
Provide false or misleading information.
Manipulate ratings, reviews, search rankings, recommendations, or Platform metrics.
Create fake accounts.
Engage in fraudulent, deceptive, abusive, or malicious conduct.
Violate the intellectual property, privacy, publicity, contractual, or legal rights of others.
Use the Platform for spam, unsolicited promotions, or unauthorized advertising.
Attempt to interfere with another User's or Creator's experience.
Use the Platform for money laundering, terrorist financing, sanctions evasion, or any other illegal financial activity.
6.3 Platform Integrity
Users shall not engage in any activity intended to manipulate, exploit, damage, overload, disrupt, or compromise the integrity, performance, or security of the Platform.
Shawir reserves the right to investigate any activity that may threaten the stability, security, fairness, or operation of the Platform.
6.4 Communications
Users are solely responsible for the communications they initiate or participate in through the Platform.
You agree that you will not:
Harass or intimidate another person.
Threaten violence.
Promote discrimination or hate.
Share unlawful, offensive, defamatory, or obscene material.
Solicit illegal goods or services.
Encourage self-harm, criminal conduct, or dangerous activities.
Misrepresent your identity or qualifications.
6.5 Session Acknowledgement
Before initiating certain Services or Sessions, Shawir may require Users to review and acknowledge additional notices, warnings, eligibility requirements, disclaimers, or service-specific terms.
By proceeding with a Session after such acknowledgement, the User confirms that they understand and accept:
The nature of the Service.
The role of the Creator.
The limited role of Shawir as a technology platform.
Any service-specific terms applicable to that Session.
6.6 Account Security
Users are solely responsible for maintaining the confidentiality of their login credentials.
Any activity performed through a User's account shall be deemed to have been performed by that User unless Shawir determines otherwise following an investigation.
Users must immediately notify Shawir if they become aware of:
Unauthorized access.
Suspected account compromise.
Lost devices containing login credentials.
Security incidents affecting their account.
Failure to promptly notify Shawir may affect the availability of certain remedies.
6.7 Fraud Prevention
To protect the Platform and its community, Shawir may investigate suspicious transactions, account activity, communications, payment patterns, device information, login behavior, or other indicators of fraud or abuse.
Where Shawir reasonably suspects fraudulent, abusive, deceptive, or unlawful activity, it may:
Suspend transactions.
Restrict Platform functionality.
Delay payments or withdrawals.
Request additional verification.
Suspend or terminate accounts.
Report suspected criminal activity to competent authorities.
6.8 Enforcement
Shawir reserves the right, at its sole discretion and without prior notice, to investigate any suspected violation of these Terms.
Where appropriate, Shawir may:
Remove Content.
Restrict Platform functionality.
Suspend or terminate accounts.
Cancel Sessions or transactions.
Withhold payments where permitted by law.
Preserve evidence.
Cooperate with law enforcement or regulatory authorities.
Take any other action reasonably necessary to protect the Platform, its Users, or its business interests.
Failure by Shawir to enforce any provision of these Terms shall not constitute a waiver of its rights.
Section 7 – Creator Obligations and Conduct
7.1 Independent Status
Creators operate independently and are not employees, representatives, agents, partners, contractors, joint venture participants, franchisees, or legal affiliates of Shawir.
Nothing contained in these Terms creates an employment relationship, partnership, agency, fiduciary relationship, joint venture, franchise, or similar legal relationship between Shawir and any Creator.
Creators remain solely responsible for their Services, Content, pricing, qualifications, communications, conduct, and business activities.
7.2 Creator Responsibilities
By registering as a Creator, you agree to:
Provide accurate, truthful, and complete information.
Maintain an authentic and up-to-date profile.
Deliver Services professionally, honestly, and in good faith.
Honor confirmed Sessions whenever reasonably possible.
Maintain respectful communications with Users.
Comply with all applicable laws, licensing requirements, tax obligations, and professional regulations.
Maintain the confidentiality of User information.
Avoid conflicts of interest where reasonably applicable.
Accept full responsibility for all Services, Content, statements, recommendations, and communications you provide.
7.3 Creator Content
Creators retain ownership of the original Content they create.
By publishing Content on the Platform, the Creator grants Shawir a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:
Host the Content.
Display the Content.
Reproduce the Content.
Distribute the Content.
Promote the Platform using the Content.
Improve, secure, maintain, and operate the Platform.
Adapt, resize, compress, or technically modify Content where necessary for Platform functionality.
Creators represent and warrant that:
They own or control all necessary rights in their Content.
Their Content does not infringe third-party rights.
Their Content complies with applicable law.
Their Content complies with these Terms.
7.4 Prohibited Content and Conduct
Creators must not publish, upload, offer, promote, request, encourage, or participate in any Content or activity that:
Violates applicable law.
Is fraudulent or deceptive.
Contains false or misleading information.
Promotes violence, terrorism, extremism, discrimination, or hate.
Contains sexually explicit, pornographic, exploitative, or abusive material.
Exploits or endangers minors.
Infringes intellectual property rights.
Violates privacy rights.
Promotes illegal goods or services.
Encourages self-harm or criminal activity.
Constitutes professional misconduct.
Violates Shawir's Community Standards or future Platform policies.
Shawir reserves the right to remove any Content or restrict any Creator account whenever it reasonably believes such action is necessary to protect the Platform, Users, or legal compliance.
7.5 Creator Availability
Creators are responsible for maintaining accurate information regarding:
Availability.
Pricing.
Services.
Qualifications.
Profile information.
Repeated cancellations, prolonged inactivity, poor responsiveness, repeated complaints, or consistently poor User experience may affect:
Profile visibility.
Verification status.
Promotional eligibility.
Search rankings.
Access to monetization features.
Continued participation on the Platform.
7.6 Compliance Monitoring
Shawir may periodically review Creator accounts to verify continued compliance with:
These Terms.
Community Standards.
Verification requirements.
Applicable laws.
Payment policies.
Platform integrity requirements.
Failure to cooperate with compliance reviews may result in account suspension or termination.
Section 8 – Content and Intellectual Property
8.1 User-Generated Content
The Platform enables Users and Creators to create, publish, upload, transmit, receive, and share Content.
All Content remains the sole responsibility of the individual or entity that created or published it.
Shawir does not assume responsibility for User-generated or Creator-generated Content except where required by applicable law.
8.2 Content Ownership
Except as expressly stated in these Terms, Users and Creators retain ownership of the original Content they create.
Nothing contained in these Terms transfers ownership of intellectual property rights to Shawir.
8.3 License Granted to Shawir
By uploading, publishing, transmitting, submitting, or otherwise making any Content available through the Platform, you grant Shawir a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:
Host, store, and process the Content.
Display and publish the Content within the Platform.
Reproduce, distribute, and transmit the Content.
Adapt, resize, compress, format, translate, or technically modify the Content where reasonably necessary for Platform functionality.
Promote, advertise, and market the Platform using such Content.
Improve, maintain, secure, develop, and operate the Platform.
Comply with legal and regulatory obligations.
This license remains effective only for as long as reasonably necessary to operate the Platform, fulfill legal obligations, resolve disputes, enforce these Terms, or protect Shawir's legitimate business interests.
Nothing in this Section transfers ownership of your intellectual property to Shawir.
8.4 Content Moderation
Shawir is under no obligation to monitor, pre-screen, review, edit, or approve Content before or after publication.
However, Shawir reserves the right, at its sole discretion and without prior notice, to:
Remove any Content.
Restrict access to any Content.
Disable or suspend Content.
Suspend or terminate accounts.
Preserve Content where required by law.
Cooperate with governmental, judicial, or regulatory authorities.
Take any action reasonably necessary to protect the Platform, Users, Creators, or third parties.
8.5 Intellectual Property Rights
Users and Creators agree to respect the intellectual property rights of others.
You may not upload, publish, reproduce, distribute, transmit, display, or otherwise use any Content unless:
You own the necessary rights; or
You have obtained all required licenses, permissions, or authorizations.
You remain solely responsible for any infringement relating to:
Copyright.
Trademarks.
Patents.
Trade secrets.
Design rights.
Privacy rights.
Publicity rights.
Any other proprietary or legal rights.
8.6 Reporting Infringement
If you believe that any Content available through the Platform infringes your intellectual property rights or any other legal rights, you may notify Shawir by providing sufficient information to enable us to investigate the matter.
Shawir reserves the right to:
Request additional information.
Remove disputed Content.
Restrict access to disputed Content.
Suspend related accounts.
Take any other action it considers appropriate while the matter is under review.
Submission of a complaint does not guarantee removal of the Content.
Section 9 – Points, Payments and Refunds
9.1 Points System
Shawir operates a virtual Points system for purchasing Services and other eligible transactions available through the Platform.
Points:
May only be used within the Platform.
Have no monetary value outside the Platform unless expressly required by applicable law.
Are not legal tender.
Are non-transferable unless expressly permitted by Shawir.
May not be sold, assigned, pledged, exchanged, or redeemed for cash except where expressly authorized by Shawir or required by law.
Shawir reserves the right to introduce additional virtual balances, credits, rewards, or similar digital assets in the future.
9.2 Purchasing Points
Users may purchase Points through payment methods approved by Shawir, including:
Credit and debit cards.
Apple App Store.
Google Play.
Third-party payment providers.
Digital wallets.
Any future payment methods supported by Shawir.
Prices, exchange rates, taxes, fees, supported currencies, payment methods, and purchasing limits may vary by country and may be modified at any time.
All payment transactions are additionally subject to the terms and conditions of the applicable payment provider.
9.3 Creator Pricing
Each Creator independently determines the prices of the Services offered through the Platform.
Shawir does not control Creator pricing.
Shawir may charge Platform fees, processing fees, service fees, commissions on payment processing, currency conversion fees, operational margins, or other commercial charges in connection with transactions, provided such charges are disclosed where applicable.
Unless expressly stated otherwise, such charges shall not reduce the Creator's published Service price.
9.4 Creator Earnings and Payouts
Creator earnings become eligible for payout in accordance with Shawir's payout policies after successful completion of eligible transactions.
Shawir may establish and modify:
Minimum payout thresholds.
Holding periods.
Verification requirements.
Processing times.
Supported payout methods.
Transaction limits.
Applicable fees.
Shawir reserves the right to delay, suspend, reject, offset, or withhold payouts where reasonably necessary for:
Fraud prevention.
Security investigations.
Chargebacks.
Payment disputes.
Regulatory compliance.
Court orders.
Tax obligations.
Anti-money laundering requirements.
Any other legitimate business or legal reason.
9.5 Refund Policy
Refund requests are reviewed individually.
Unless otherwise required by applicable law or expressly approved by Shawir:
Purchases of Points are final.
Purchased Points are non-refundable.
Completed Sessions are non-refundable.
Partially completed Services may be reviewed on a case-by-case basis.
Approved refunds may be issued as Points, Platform credit, original payment method, or any other method determined by Shawir.
Submitting a refund request does not create any entitlement to receive a refund.
Refund decisions are made at Shawir's sole discretion except where prohibited by applicable law.
9.6 Taxes
Users and Creators are solely responsible for:
Taxes.
Duties.
Withholding obligations.
Reporting requirements.
Government charges.
Regulatory compliance.
Where required by law, Shawir may collect, withhold, report, or remit taxes or governmental charges on behalf of Users or Creators.
9.7 Promotional Credits
Shawir may issue:
Promotional Points.
Rewards.
Bonuses.
Referral incentives.
Coupons.
Credits.
Discount vouchers.
Loyalty benefits.
Marketing incentives.
Unless expressly stated otherwise, promotional balances:
Have no cash value.
Cannot be withdrawn.
Cannot be transferred.
May expire.
May be modified or cancelled.
May be revoked in cases of abuse, fraud, or violation of these Terms.
Section 10 – Creator Account Status and Platform Participation
10.1 Account Activation
Following successful approval, a Creator account will be activated and made available on the Platform, subject to Shawir's eligibility requirements and ongoing compliance with these Terms.
Activation of a Creator account does not guarantee:
Visibility on the Platform.
Search ranking.
User engagement.
Bookings.
Earnings.
Continued participation in the Platform.
10.2 Performance Requirements
To maintain the quality and integrity of the Platform, Shawir may establish minimum performance standards for Creators, including but not limited to:
Account completeness.
Verification status.
Responsiveness.
Service quality.
User satisfaction.
Community compliance.
Platform activity.
Booking performance.
Revenue activity.
Content quality.
These standards may be revised at any time to improve the overall Platform experience.
Failure to meet such standards may affect:
Profile visibility.
Search rankings.
Promotional eligibility.
Verification status.
Access to monetization features.
Continued participation in the Platform.
10.3 Profile Visibility

Community compliance.
Service quality.
User engagement.
Platform performance metrics.
Other ranking criteria determined by Shawir.
Shawir does not guarantee:
Search rankings.
Featured placement.
User impressions.
Bookings.
Revenue.
Profile visibility.
10.4 Inactive Accounts
Creator accounts that remain inactive for an extended period may be:
Hidden.
Restricted.
Archived.
Suspended.
Removed from search results.
Subject to re-verification.
The applicable inactivity period shall be determined by Shawir according to operational requirements.
10.5 Commercial Programs
Shawir may introduce, modify, suspend, or discontinue:
Subscription plans.
Membership programs.
Verification programs.
Premium services.
Promotional campaigns.
Advertising programs.
Featured listings.
Creator benefits.
Revenue programs.
Other commercial offerings.
Participation in such programs may be subject to separate eligibility criteria and additional terms.
10.6 Platform Integrity
To maintain the quality, safety, and integrity of the Platform, Shawir reserves the right to suspend, restrict, re-evaluate, or permanently terminate any Creator account that:
Violates these Terms.
Violates Community Standards.
Receives repeated substantiated complaints.
Provides consistently poor User experiences.
Remains inactive for prolonged periods.
Engages in deceptive, fraudulent, abusive, or unlawful conduct.
Misuses Platform features.
Poses a legal, operational, financial, or reputational risk to Shawir or its Users.
All such decisions are made at Shawir's sole discretion.

are owned by or licensed to Shawir and are protected under applicable intellectual property laws.
Nothing contained in these Terms transfers ownership of any Shawir intellectual property.
Users and Creators receive only a limited, revocable, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.
11.2 Creator Intellectual Property
Creators retain ownership of the original intellectual property associated with the Content they create.
Nothing in these Terms transfers ownership of Creator intellectual property to Shawir.
The license granted under Section 8 is limited to operating, securing, maintaining, improving, marketing, and providing the Platform.
11.3 User Content
Users retain ownership of their original messages, reviews, ratings, comments, and other original Content submitted through the Platform.
By submitting such Content, Users grant Shawir the rights reasonably necessary to:

If you submit suggestions, ideas, recommendations, comments, feature requests, improvements, or other feedback regarding the Platform, you grant Shawir a perpetual, worldwide, irrevocable, royalty-free, transferable right to use, modify, commercialize, implement, publish, sublicense, and exploit such feedback without restriction or compensation.

Nothing contained in these Terms limits any mandatory consumer rights that cannot legally be excluded under applicable law.

16.2 Severability
If any provision of these Terms is determined by a court or competent authority to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
